The Provisions website and online ordering system (“Website”) is operated by Compass Group B&I Hospitality Services Pty Ltd (ABN 82 089 388 143) and or its related bodies corporate (“Us” or “We”). By using the Website or ordering catering from Us, You agree to and accept the following terms and conditions.

Administration: You acknowledge that the Website is administered by third party providers. We will use commercially reasonable efforts to ensure the Website will be free from viruses or other harmful components. You agree to hold Us harmless from any claim, judgement, loss, expense, liability from any viruses, or harm suffered by You as a result of using the Website. We reserve the right to alter the agreed price if an incorrect price was caused by software error, fault or malicious attack.

Changes: We may from time to time amend, update or change the Website including these Terms and Conditions without prior notice.

Ordering: You acknowledge that all orders are treated as an express intention to purchase the nominated goods or services for the agreed online prices at the time the order is made. Orders must be placed with a minimum of 48 hours (2 business days) prior notice.

Minimum Order Value: The minimum order value is $90 plus GST. Should You require more flexibility please contact us at provisions@compass-group.com.au and we will do our best to accommodate Your request.

Late/Urgent Orders: Please email provisions@compass-group.com.au for any late or urgent requests required on less than 48 hours (2 business days) notice. We will always endeavour to fulfill such orders however, product substitutions may be necessary.

Cancellations: For standard orders, You can amend or cancel Your order via email to provisions@compass-group.com.au no later than 24 hours (1 business day) before Your booking. To cancel Your order please email provisions@compass-group.com.au and include Your order number. Orders cancelled or amended within 24 hours (1 business day) will be charged in full. Longer lead times will apply for Bespoke orders, catering services, equipment hire and other services.

Bespoke Orders and Quotes: If you can’t find what you need on the website, or just need a quote, please email Us at provisions@compass-group.com.au.

Catering Services and Equipment Hire: Please email Us at provisions@compass-group.com.au to find out more if you are interested in having Us attend your premises to serve food and drinks at your event or if you require equipment hire or other services. We will need a minimum of 7 days’ notice and may need you to sign a separate agreement for the additional goods and services. Any labour costs will be charged on a minimum of four hours, plus travel time from Our Production Facility to Your premises. You agree that You will be charged for any additional hours worked at your event as a result of changes to the planned run of events, equipment at venue, hired in or supplied by You or by circumstances out of our control. Cancellations of these services must be made 5 days prior to the event to receive a full refund. Any cancellations made between:

a. 120-72 hours will be charged at 50%;

b. 72-24 hours will be charged at 75%; and

c. with 24 hours or less will be charged at 100%.

Personnel – If you would like Us to attend your premises to serve food and drinks at your event, We will provide all necessary personnel who will be adequately trained and hold all necessary permits and qualifications to complete their duties in the performance of the services. You will grant Us and our personnel a licence to access and use your premises for the purpose of performing the services, free of any charge. The licence will include the provision of appropriate work, office, and storage facilities by You so as to enable Us and our personnel to carry out the services in a proper, efficient and safe working environment and in accordance with the applicable legislation and any industrial award applicable to our onsite personnel. You will provide all necessary equipment to allow our personnel to provide the services, including without limitation, kitchenware, china, crockery, cutlery, glassware, tableware and utensils, all of which you will maintain in good working order.

Payment: Payment must be made through our website via credit or debit card at the time of placing your order. No order will be processed without payment and no cash payments will be accepted. Our prices and menu offerings are updated from time to time. In the unlikely event that an item is out of stock or your selected time for pick up is unavailable you will be contacted by one of our representatives to make alternate arrangements. We are not liable to You or anyone else if errors occur in the information on this web site or if that information is not up to date.

Deliveries: You must be available to accept delivery from your nominated delivery address. The delivery ordered will be fulfilled by Us or a third party contracted by Us. We will use all reasonable endeavours to ensure Your order is delivered within the timeframe requested, however factors outside of Our control, including but not limited to traffic and weather conditions, may prevent on time delivery. You will still be charged for Your order for failed deliveries caused by you including but not limited to Your failure to come to the door or pick up the phone when contacted by the driver, Your provision of incorrect contact or delivery information or in circumstances where the delivery driver is unable to find a safe location to leave the order where You fail to come to the door. Delivery fees may apply and will be calculated at the point of ordering.

Reviews and Comments: If you choose to post a review or comment on this website, you grant us and our affiliates a right to use, reproduce, modify, distribute and display such reviews and comments throughout the world in any media.

Refund Policy: If you are not satisfied with a particular item, please let Us know by emailing provisions@compass-group.com.au within 48 hours of receipt of your order and include the full details of what You ordered and why You were unsatisfied. We will then raise this with the Provisions Central Production Kitchen and if deemed appropriate, in our sole discretion, a refund or part refund will be provided for the unsatisfactory item(s).

Consumption & Labelling of your Order: Refer to Provisions label that notes the date by when the products must be consumed. Generally, we recommend our food is consumed on the same day of delivery if refrigerated, or within four (4) hours of the time of your order if left unrefrigerated. Provisions takes no liability for any food consumed after this time. If food is required to be reheated, You must remove food from all packaging and reheat until piping hot in the centre using a microwave or oven.

Allergens: We try and provide options on Our menus for all dietary requirements including vegetarian, vegan, lactose, gluten and dairy free. To ensure Your specific dietary requests are met appropriately, please detail Your requirements when placing Your order. Please be aware that Our food may contain or come into contact with common allergens, such as dairy, eggs, sesame, lupins, sulphites, milk, wheat, soy, tree nuts, peanuts, fish, crustacea and molluscs. Please consider this when requesting special dietary requirements. Please speak directly with Us for food allergy information. Alcohol: We support the Responsible Service of Alcohol and reserve the right, in Our absolute discretion, to decline or cancel any order and purchase by You if we reasonably believe that such an order or purchase may be in breach of the terms of the Licences (NSW LIQP770017846 or NSW LIQO660030978) including without limitation the below mentioned terms and conditions and/or the applicable laws and regulations in relation to the sale and supply of liquor. If you look under 25 years old we will decline or cancel part of or the whole of your order and purchase, subject to sighting proof of age by way of a valid photo identification. If anyone present at the premises at the time of delivery looks under 25 years old, we will decline or cancel part of or the whole of your order and purchase, subject to sighting proof of age by way of a valid photo identification. If you or anyone present at the premises at the time of delivery show signs of intoxication either when placing your order or at the time of delivery, part of or the whole of your order will be declined or cancelled. Liquor will not be delivered and left at unoccupied premises for any reason at any time. Alcohol is only available in NSW, and for delivery (not pick up). Orders must be placed at least one day in advance. WARNING: Under the Liquor Act 2007 (NSW), it is an offence to; supply liquor to a person under the age of 18 years, for a person under the age of 18 years to purchase or receive liquor and to sell or supply alcohol to intoxicated persons.

Intellectual Property Rights: all intellectual property on or created through the use of the Website is between you and us, owned by us or our affiliates. You may not copy, reproduce, republish, download, post, broadcast, transmit, make available to the public, or otherwise use any content on our site in any way except for your own non-commercial use.
